As Attorney General Jeff Sessions announced the end of the Obama-created Deferred Action for Childhood Arrivals (DACA), from which more than 800,000 un-vetted young illegal aliens have been given protected status and work permits, the number of them who are convicted criminals, gang members, or suspects in crimes remains staggering.

Below, Breitbart News has compiled a list of 50 of the 2,139 DACA recipients, deemed “DREAMers” by the open borders lobby, who have had their temporary protected status revoked due to crimes including: “A felony criminal conviction; a significant misdemeanor conviction; multiple misdemeanor convictions; gang affiliation; or arrest of any crime in which there is deemed to be a public safety concern,” according to the United States Citizenship and Immigration Services (USCIS) agency.

The majority of crimes by DACA recipients include: “Alien smuggling, assaultive offenses, domestic violence, drug offenses, DUI, larceny and thefts, criminal trespass and burglary, sexual offenses with minors, other sex offenses and weapons offenses,” USCIS has stated.

DREAMer Who Killed Two Girls in Hit-and-Run Won’t Be Deported

Cinthya Garcia-Cisneros, an illegal alien protected by DACA, was convicted in 2014 of two counts of felony hit and run after she killed two Forest Grove, Oregon, stepsisters — Anna Dieter-Eckerdt and Abigail Robinson ages 6 and 11 respectively — who were playing at the time of the incident, as Breitbart News reported.

A judge also threw out Garcia-Cisneros’ deportation case after her murder conviction.

Illegal Arrested for Child Sex-Abuse Was Protected By Obama’s Migrant Amnesty

Breitbart News reported in January 2016:

The illegal immigrant who was arrested this week in Arizona for a sex crime against a three-year old girl, was being shielded from repatriation by President Barack Obama’s 2012 ‘Deferred Action for Childhood Arrivals’ program, according to the Senate Judiciary Committee.

The little girl was found Monday, while duct-taped, inside a trash bag, and covered in feces in a closet in an apartment occupied by Francisco Rios-Covarrubias. He was charged with kidnapping, sexual conduct with a minor, felony child abuse, and sex trafficking. The child’s mother was also arrested.

DREAMer Murdered American Teen in Sanctuary City

Laura Wilkerson explained what occurred to her son, Josh, at the hands of an illegal alien protected by DACA in 2013, Breitbart News reported:

We found out later that what he [Hermilio Moralez] did was he asked Josh for a ride home from school and Josh said, ‘sure,’” Wilkerson said. “I think he’d given him a ride home two or three times before. He took him actually to his parents’ house. For some reason, we found out later why, what he did to Josh was he hit him in the nose, and this is what the kid tells from the stand, he hit him in the nose so hard that it would blind him so that he couldn’t fight back. Then he kicked him so hard in the stomach. Josh was about this big around and he weighed about 100 pounds in the body bag. He kicked him so hard in the stomach that his liver sliced in two and his spine sliced in two. He ruptured his spleen. He took a closet rod and beat Josh over the head so hard with it that it broke in four pieces. He strangled him, then let him go. Strangled him, let him go. Per the medical examiner, it was just torturous. After he murdered him, as he said, when Josh quit having bloody bubbles come out of his nose, he knew he was gone, he tied him up like an animal with about 13 ropes from his the back of his neck to the back of his hands, to the back of his feet. He covered his head with his school shirt. Then he put him in the back of my son’s truck and he drove around and he took two dollars out of Josh’s wallet and he stopped and bought gas. Then he took him to a field and he took his wallet and school ID out and just placed it by the body. Then he doused him with gas and set him on fire. It was just incredible.

DREAMer Accused of Raping Woman in Sanctuary City

Salvador Diaz-Garcia, 23, is facing second-degree assault and rape charges for an alleged brutal attack on a 19-year-old woman in Burien, Washington, Breitbart Texas reported.

According to court documents, the woman was on a treadmill at her local gym when Garcia allegedly stood behind her and asked her questions. The woman said she asked Garcia to move. Garcia allegedly attacked the woman, breaking her jaw and nose, and ripping half of her ear off.

Father of Murdered Florida Mother Reveals Suspected Killer Was DACA Recipient

Curt is the father of Kelsey Engelsen, the 24-year-old woman who was allegedly murdered outside a bar by alleged DACA recipient and convicted felon Carlos Ruben Rodriguez, 24-years-old, as Breitbart News reported.

As previously reported by FOX 4 Now, Rodriguez has been charged with second-degree murder following the incident in which he and another man were allegedly in a fight. Witnesses say that’s when Rodriguez began allegedly shooting, killing Engelsen, and wounding another woman, Cassandra Santos.

Three DREAMers Arrested in Nationwide Gang Crackdown

Three illegal alien gang members arrested in an ICE operation back in May had protected status under the Obama-era DACA program. Since DACA’s inception, more than 1,500 illegal immigrants saw their protected status revoked after they were found to be involved with a gang or committed a crime, Breitbart Texas reported.

DREAMer Allegedly Helped Drag Queen Smuggle Illegal Aliens in Texas

Juan Valdez Molina, an illegal alien protected by DACA, was accused by Texas authorities of helping a drag queen smuggle illegal aliens across the U.S.-Mexico Border, Breitbart Texas reported. For his alleged part in the human smuggling conspiracy, Valdez was expected to be paid $1,000.

23 Amnesty Recipients Arrested In Nationwide Crime Sweep

Breitbart News reported in March 2015:

Of 2,059 criminal immigrants arrested in a recent nationwide sweep, 23 were beneficiaries of President Obama’s 2012 amnesty, or the Deferred Action for Childhood Arrivals program, according to DHS.

The nearly two dozen illegal immigrants had been shielded from deportation by DACA, and while all 23 had been part of the program eight failed to get their status renewed, meaning that 15 of the arrested criminal aliens were current DACA recipients, the Washington Times reported Thursday.

15 DREAMers Arrested for ‘Dangerous’ Crimes

According to an Associated Press report, “federal agents in a sweep targeting the most dangerous criminal immigrants arrested 15 people” who received temporary amnesty, Breitbart News reported in 2015.

A U.S. official who was briefed on the arrests told the Associated Press that 14 “of the 15 had been convicted of a crime.”

DREAMer Faces Deportation after Drug Allegations

Juan Manuel Martinez, 19, will soon become one of a few DACA recipients who will be deported back to his native country after run-ins with the law, Breitbart Texas reported in May.

Earlier this year, Martinez was arrested for drug possession after Monterey County sheriff’s deputies found meth and marijuana in his vehicle. Martinez was also charged with trespassing, which he later pleaded no contest to.

DREAMer Arrested in Sexual Predator Sting near Texas Border

Hernandez-Rodas, an illegal alien protected by DACA, was charged with child sex crimes after he allegedly lured a 14-year-old girl, who ended up being a federal agent, into a hotel room for sex, Breitbart Texas reported.

DREAMer Deported to Mexico After Embezzlement Charges

Gus Zamudio, 18, returned to Mexico City nearly a month before he was expected to graduate from art school, Breitbart Texas reported in May.

Zamudio allegedly embezzled approximately $3,000 from Harris Teeter, the grocery store he was working for in February, according to police. Zamudio’s attorney pleaded down the felony charges, but the illegal immigrant remained in law enforcement custody."

Those 800,000 entered the United States Of America ILLEGALLY by hopping OVER, UNDER, or THROUGH the BORDER.

They are TRESPASSERS! Whether their ILLEGAL Parents dragged them along with them or they simply came over on there own.

Gregg Jarrett: Trump, in DACA decision, restores constitutional sanity to immigration laws

"By executive fiat, President Obama granted amnesty to immigrants living illegally in the United States.

It was an unconstitutional act, to be sure. Obama had previously admitted he had no authority to end deportations of illegal aliens when he said, “The notion that somehow I can just change the laws unilaterally is just not true.” Then he went about doing it anyway, conjuring a new breadth of hypocrisy.

His successor, President Trump, is now taking the first step toward restoring sanity to the rule of law as it applies to the Constitution and immigration.

By rescinding the Obama-created Deferred Action for Childhood Arrivals (“DACA”) program that gave a deportation reprieve to illegal immigrants who came to the U.S. as children, Trump is returning legislative authority to the legislature. He is reinstating the separation of powers that are fundamental to our democracy.

Usurping Legislative Authority

Under the Constitution, congress is vested with writing laws and the president is charged with executing those laws. This is especially true when it comes to immigration.

At the end of the 19th century, the U.S. Supreme Court declared that congress has “plenary power” (meaning full and complete) to regulate immigration. Derived from Article I, Section 8 of the Constitution, the doctrine is based on the concept that immigration is a question of national sovereignty, relating to a nation’s right to define its own borders and restrict entrance therein.

As the high court observed,“Over no conceivable subject is the legislative power of Congress more complete.” (Oceanic Stem Navigation Co. v. Stranahan, 214, U.S. 320)

Nevertheless, Obama decided to usurp this power by unilateral directive, unconstrained by established checks and balances. In so doing, he granted himself extra-constitutional authority and upset the carefully balanced separation of powers. He also subverted the nucleus of our constitutional design: the rule of law.

The only exception to the power of congress in dictating immigration is the 1952 statute in which the legislative branch transferred its authority to the president in cases involving national security. The president is specifically empowered to restrict foreigners from entering the country to protect the safety and security of Americans. This law formed the basis for President Trump’s travel ban.

In all other immigration matters, only congress is authorized to make laws which the president must enforce.

Distorting Prosecutorial Discretion

Those who supported Obama’s actions not to enforce the law argued that he was merely engaging in “prosecutorial discretion”. It is one of those wonderfully fungible phrases in the law. Elastic because it is vague and ambiguous. Useful because it can be easily abused.

Obama appropriated this doctrine to justify his near boundless discretion to amend, revise, waive or suspend the execution of immigration laws. As chief executive, he empowered himself to decide what laws may be enforced or ignored and what persons may come or go across our southern border irrespective of what the law actually states.

In past decisions, the Supreme Court cautioned the executive branch that its prosecutorial discretion, while broad, is not “unfettered.” (U.S. v. Batchelder, 442 U.S. 114) It is subject to restrictions. The doctrine may not be used to adopt a sweeping policy of non-enforcement of the law. It applies only to decisions not to prosecute or expel specific individuals or small groups of people, typically for exigent reasons like war, civil unrest or political persecution.

By contrast, Obama bestowed a wholesale, blanket amnesty for an entire class of people. He did so not for the reasons allowed by law, but for purposes that were purely political. It was a flagrant abuse of prosecutorial discretion.

The centerpiece of Obama’s 2014 amnesty program was the Deferred Action for Parents of Americans and Lawful Permanent Residents, widely known as “DAPA”. But this law never went into effect because a federal judge blocked it, declaring that the program was a likely abuse of executive powers. The U.S. Court of Appeals for the Fifth Circuit agreed, and that decision was left intact by the Supreme Court.

With several states vowing a similar challenge to DACA, it was destined for the same judicial fate. That is, an unconstitutional order.

Breaching His Sworn Duty

Obama insisted he was forced to act because “congress failed to act.” It was an appealing political argument, but utterly untrue. Congress did act by passing a law in 1996 requiring federal agents to deport illegal immigrants, with few exceptions. The statutory language is mandatory. That law remains in effect today. Yet, Obama breached his sworn duty by failing to enforce the law. Instead, he ordered immigration agents, in effect, to break the law.

Article II, Section 3 of the Constitution requires that the President “shall take Care that the Laws be faithfully executed.” Nowhere is it written that the chief executive is granted the latitude to pick and choose which laws he wants to enforce. He cannot ignore or nullify laws he does not like because the Constitution gives him no power not to execute laws.

To infer such latitude would invite an authoritarian rule anathema to our Founding Fathers’ vision. Obama admitted as much when he said, “The fact of the matter is, there are laws on the books that I have to enforce.” He was specifically referring to immigration laws. The Constitution does not permitted a president to engage in a de facto repeal of an existing law. To do so is, quite simply, lawlessness and a dereliction of duty.

If a president can refuse to enforce a valid federal law, are there any limits to his powers? What is to stop a president from rewriting other laws with which he disagrees? Or to act where congress has declined or refused to act? Why even have a legislative branch of government at all? What is the point of a Constitution which enumerates and circumscribes powers and duties?

President Trump will be criticized for revoking his predecessor’s immigration program. But his decision bears fidelity to the Constitution and the rule of law.

Only congress is empowered to alter immigration laws that affect those who are here in the U.S. illegally. It can either pass a new law or decline to do so. A determination not to act is, by itself, a deliberate act. This is how the Framers constructed our system of government.

Congress considers and debates a great many bills. Not all of them pass. This is not a “failure” in a conventional sense, but a decision by declination. It constitutes a prudent and calculated process.

Obama twisted the law, ignored the Constitution, and abdicated his primary responsibility as chief executive.

President Trump is moving in a different direction."

Can Congress produce legislation to replace DACA?

"The most important thing to understand about President Trump's decision Tuesday to wind down the DACA program, which has allowed 800,000 immigrants brought to this country illegally as children to stay here, is just how legally shaky DACA was.

Before issuing the executive order creating DACA – which stands for Deferred Action for Childhood Arrivals – President Obama had repeatedly said he did not have the authority to change immigration law on his own.

President Obama then changed his mind. The courts, including the Supreme Court in 2016, enjoined a similar law for adults. Legal scholars predicted DACA would be declared invalid within a year.

President Trump's decision to end DACA – but to allow a 6-month grace period so Congress can codify changes in the law that could let so-called Dreamers stay – is being attacked from left and right.

To liberals, the president’s move represents the creation of heartless uncertainty. For conservatives, immigration hawk Rep. Steve King, R-Iowa, says the president's action will touch off a "big, civil war" among Republicans.

In reality, the president is this time keeping his cool and navigating the turbulent political waters here prudently.

President Trump isn’t keeping the specifics of the DACA order, which grants a two-year renewable work permit to recipients while blocking any deportation actions against them unless a criminal record is involved. But President Trump says he will work with Congress to reach a viable solution.

A statement by the president Tuesday echoes DACA supporters in one respect: "I do not favor punishing children, most of whom are now adults, for the actions of their parents," President Trump said.

Candidate Trump’s heated campaign rhetoric last year led many people to believe he really did want to deport millions of undocumented immigrants. But his attention-grabbing soundbites were belied by his previous positions on the subject.

Back in 2012, when he was mulling over a run for president, Trump told an interviewer he was “probably down the middle” on immigration issues. After his election in 2016, he said he would focus on deporting "bad hombres" with criminal records and leave the Dreamers alone while the issue was sorted out.

The genius of Trump on the campaign trail was that he sent two different messages on immigration. On the one hand, he called for a border wall and bizarrely claimed he would get Mexico to pay for it. On the other hand, he said he would build a “big beautiful door” in the wall to let in legal immigrants. He reiterated that stand after the election, when he told a rally that he expected the wall would let in both legal immigrants and guest workers.

With his acknowledgement Tuesday that he expected to sign a compromise on the Dreamer issue, President Trump is actually proving himself a good player in the game of the political two-step. Activists on both sides of the political spectrum are upset, but the vast majority of voters in the middle will probably see it as a reasonable compromise.

Of course, members of Congress are already posturing. Rep. Joe Crowley, D-N.Y., is accusing Trump of "hostage taking" should the president try to tie Dreamer status to, say, funding for his border wall. But in the end, the political onus will be on Democrats if they block Dreamer legislation because they refuse to link it to any other issue.

If President Trump plays his cards right, his move Tuesday is smart politics. With new guidelines in place that make it easier to deport unwanted or criminally minded immigrants, the president can feel free to be flexible and even generous with other immigrants.

The end result will satisfy neither President Trump’s most fanatical supporters nor his critics. But it is certainly likely to work better than the chaotic status quo on immigration."
